Question 7: Who has the burden of persuading the Commission or its staff that my proposal can be excluded?

Except as otherwise noted, the burden is on the company to demonstrate that it is entitled to exclude a proposal.

SLB 14

SLB 14 states that the Commissions staff will not consider any basis of exclusion that is not advanced by the company
The staff considers authorities advanced by the company or the proponent and may conduct independent research
Determinations by the staff are not based solely on the subject matter of the proposal. The staff will also consider the way in which the proposal and supporting materials are drafted.
