- The PSLRA has made it
substantially harder for plaintiffs to pursue lawsuits alleging
securities fraud. Nevertheless, as the Supreme Court recently noted in
Tellabs, private securities litigation is an indispensable tool crucial
to the integrity of domestic capital markets with which defrauded
investors can recover their losses. Here, plaintiffs have satisfied the
heightened pleading requirements of the PSLRA. Accordingly, defendants'
motions to dismiss the second amended complaint are hereby denied. The court
will hold a status conference in the near future to address the next steps in
