Applies
to creditors who are subject to the
Equal Credit Opportunity Act, but are not
subject to the
Fair Credit Reporting Act
Creates
narrow exceptions to the statutory prohibition against obtaining or using medical
information in connection with determining eligibility for credit
- State of health, health history, treatment or
prognosis may not be taken into account in
underwriting a credit decision
- Only financially related medical information,
for example, medically related debts and payment history, may be utilized
